These terms and conditions ("Terms") govern your access to and use of Musicfetch, including our website, APIs, documentation, and related services (collectively, the "Service"). "Musicfetch", "we", "us", and "our" refer to the provider of the Service. "You" and "your" refer to the individual or legal entity using the Service. If you use the Service on behalf of a legal entity, you represent that you have authority to bind that entity to these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Account Registration

You must register for an account to access the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. License

Subject to these Terms and the limits of your subscription plan, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service. You may integrate the Service into your own commercial products and services and may use, reproduce, store, cache, process, and display results returned by the Service ("API Results") to your personnel, customers, and end users. This includes use in public websites and smart links, authenticated applications and dashboards, catalog and metadata tools, reporting and analytics, and automated or AI-assisted product features.

You may cache and store API Results for as long as reasonably necessary to operate your product or service. You are responsible for refreshing stored API Results as appropriate for your use case and for complying with any cache, retention, or deletion requirements stated in your subscription plan or the documentation.

You may not:

  • sell, resell, sublicense, or provide access to the Service itself;
  • share account credentials or API tokens outside your organisation or expose them in client-side or publicly accessible code;
  • provide an API, proxy, or other service that is substantially similar to or substitutable for the Service;
  • redistribute API Results as a standalone dataset, data feed, or bulk download; or
  • use the Service to build or maintain a competing music-data aggregation or link-matching service.

These restrictions do not prevent you from displaying or otherwise making API Results available as an integrated part of your own product or service.

3. Purchase and Payment

You may be required to purchase a subscription to access certain features or functionalities of the Service. The pricing and payment terms for such subscriptions will be provided to you prior to purchase. By purchasing a subscription, you agree to pay all fees and charges associated with your selected subscription plan, including any applicable taxes.

4. Free Trial

We offer a 7-day free trial to new users who register with the Services. During the free trial period, you will have access to all features and functionalities of the Service. The account will be charged according to your chosen subscription at the end of the free trial unless you cancel your subscription before the trial period ends.

5. Cancellation

You can cancel your subscription at any time by logging into your account and following the cancellation instructions. Your cancellation will take effect at the end of the current paid term. If you cancel your subscription, you will retain access to the Service until the end of your current billing cycle. No refunds or credits will be provided for any partial subscription periods. 6. Acceptable Use

You must not use the Service unlawfully, interfere with or disrupt the Service, circumvent technical restrictions or subscription limits, attempt to gain unauthorised access to the Service or another user's account, or use automated means to access the Service except through our documented APIs. You are responsible for your products and services, your end users' use of API Results, and ensuring that your use complies with applicable laws and third-party rights.

7. Disclaimer of Warranties

The Service is provided “as is“ and “as available“ without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice before the revised Terms take effect. What constitutes a material change will be determined at our sole discretion.
